§ 10.52.1035. Butte High School residential parking program.

  • The area designated pursuant to this chapter as the Butte High School residential on-street parking permit program shall be as follows:

    A.

    Restricted Parking Area Designated.

    1.

    On the east side of Main Street beginning at the intersection of Main Street and Gold Street thence northerly on Main Street, a distance of seventy-two feet according to the official map and plat of the original Butte townsite.

    2.

    On both sides of Gold Street beginning at the intersection of Gold Street and Main Street, thence easterly to the intersection of Gold Street and that alley lying and running north and south within Block 1 of the original Butte townsite, a distance of one hundred ten feet.

    B.

    No vehicle other than emergency vehicles or vehicles providing services to the area or vehicles having a permit may park on any street in the area at any time. These regulations are in effect seven days a week twenty-four hours a day.

    C.

    These regulations will primarily be enforced by the Butte-Silver Bow parking commission parking control force and may also be enforced by the law enforcement department.

    D.

    The public works department will post a minimum of two signs per block within the district that indicate these restrictions.

    E.

    The basis of the fee reflects the costs of printing, signage and administration; and recognizes that the Butte-Silver Bow parking commission parking control force will perform the primary enforcement.

    F.

    Permits shall be issued by the director of the Butte-Silver Bow parking commission. Permits may be issued for motor vehicles only upon application of the following persons:

    1.

    A legal resident of the residential permit parking area who has a motor vehicle or vehicles registered in his name, or who has a motor vehicle for his exclusive use and under his control.

    2.

    Proof of residency and vehicle ownership shall be demonstrated in a manner to be determined by the director or the Butte-Silver Bow parking commission.

    G.

    Nonresidential uses will be provided with posted time limit parking. The time limits shall be decided upon by the parking commission director and the nonresidential use owner.

    H.

    The parking commission director may issue special guest permits and temporary special gathering permits at his discretion.

    I.

    Residential permits shall become void if either the owner or operator of the vehicle moves out of the area or if the owner or operator of the vehicle sells the vehicle to an individual living outside the area. A permit holder who moves within the area or purchases another vehicle may transfer the permit for a one dollar fee.
