§ 10.52.1030. Montana Tech residential parking program.

  • The area designated pursuant to this chapter as the Montana Tech residential on-street parking permit program shall be as follows:

    A.

    Restricted Parking Area Designated.

    1.

    On Granite Street beginning at the intersection of Granite Street and Emmet Avenue thence westerly on Granite Street to the intersection of Granite Street and Ophir Street.

    2.

    The east half of Ophir Street beginning at the intersection of Ophir Street and Granite Street, thence southerly to the intersection of Ophir Street and that alley lying and running east and west within Blocks 9 and 10 of the Fairview Addition.

    3.

    The west half of Ophir Street beginning at the intersection of Ophir Street and Granite Street, thence northerly to the intersection of Ophir Street and Copper Street.

    4.

    The north half of Granite Street beginning at the intersection of Granite Street and Ophir Street thence westerly to the intersection of Granite Street and May Street. May Street is a platted but unimproved street, according to the official map and plat of the Fairview Addition.

    5.

    On Broadway Street beginning at the intersection of Broadway Street and Emmet Avenue thence westerly on Broadway Street to the intersection of Broadway Street and Western Avenue.

    6.

    On both sides of Park Street beginning at the intersection of Park Street and Emmet Avenue thence westerly to the intersection of Park Street and Western Avenue thence westerly on the north side of Park Street to the intersection of Park Street and Prospect Avenue.

    7.

    On Quartz Street beginning at the intersection of Quartz Street and Western Avenue thence westerly on Quartz Street to the intersection of Quartz Street and Prospect Avenue.

    8.

    On Copper Street beginning at the intersection of Copper Street and Western Avenue thence westerly on Copper Street to the intersection of Copper Street and Prospect Avenue.

    B.

    No vehicle other than emergency vehicles or vehicles providing services to the area or vehicles having a permit may park on any street in the area between the hours of eight a.m. and six p.m., Monday through Friday, except for holidays.

    C.

    These regulations will primarily be enforced by the parking control force.

    D.

    The public works department will post a minimum of two signs per block within the district that indicate these restrictions.

    E.

    Permits shall be issued for a year beginning August 1st.

    F.

    Guest permits shall be issued for a year beginning August 1st. No more than two guest permits shall be issued to each qualified resident for use by visitor vehicles.

    G.

    Permits shall be issued by the director of the Butte-Silver Bow parking commission. Permits may be issued for motor vehicles only upon application of the following persons:

    1.

    A legal resident of the residential permit parking area who has a motor vehicle or vehicles registered in his name, or who has a motor vehicle for his exclusive use and under his control.

    2.

    Proof of residency and vehicle ownership shall be demonstrated in a manner to be determined by the director of the Butte-Silver Bow parking commission.

    H.

    Nonresidential uses will be provided with posted time limit parking. The time limits shall be decided upon by the parking commission director and the nonresidential use owner.

    I.

    The parking commission director may issue special guest permits and temporary special gathering permits at his discretion.

    J.

    Residential permits shall become void if either the owner or operator of the vehicle moves out of the area or if the owner or operator of the vehicle sells the vehicle to an individual living outside the area. A permit holder who moves within the area or purchases another vehicle may transfer the permit for a one dollar fee.
