Chapter 10.22. USE OF ELECTRONIC DEVICES WHILE OPERATING A MOTOR VEHICLE |
§ 10.22.040. Exceptions.
The provisions of this chapter shall not apply to the following:
1.
Any person reporting a health, fire, safety or police emergency.
2.
Any ambulance services, emergency responders, governmental fire agencies, law enforcement agencies, or any other "authorized emergency vehicle" as defined in section 61-8-1022.(a) Montana Code Annotated, when such persons are using such device for nonpersonal use in the course of ordinary business in their employment with a city, state or federal agency or authority.
3.
Any passenger of a motor vehicle or persons using a hand-held electronic communications device while maintaining a motor vehicle in a stationary position, not in gear, while in a parking lane or space out of moving traffic lanes.
4.
Any person using a hands-free device as defined in this chapter.
5.
Any person using a two-way radio while in the performance and scope of work-related duties.
