§ 8.12.070. Control of undesirable vegetation.

  • Undesirable vegetation shall be kept cut to a height of not more than eight inches. It shall be the duty of the owner of any real property adjacent to any public right-of-way where the growth of undesirable vegetation exists to control the undesirable vegetation on said property and also to control weeds on the alleys abutting behind the property to the middle of the alleys and on the sidewalk area including any right-of-way area between the property line and the curb line or designated roadway. If such control in not accomplished, the Butte-Silver Bow weed board may, after following the notice and procedures provisions provided for in Section 8.12.080 order the control by or on behalf of the city and county of Butte-Silver Bow, and the procedures set out in Section 8.12.090 and 8.12.100 for collection of costs and expenses shall apply in addition to the penalties provided by this chapter. Undesirable vegetation shall not be permitted to remain upon the ground after cutting, but shall be removed.
