§ 8.08.060. Household solid waste containerization and removal.

  • A.

    All residences located in any area in which household solid waste collection is serviced by the city-county or by approved solid waste collection contractors shall have an approved container. Each residence shall be assigned one container. The type, and size of the containers, shall be prescribed by the department of public works. Should the resident desire additional containers, additional containers shall be made available and the resident shall pay the cost to purchase additional containers. Solid waste placed within any container other than an approved container shall not be picked up by the city-county or its solid waste contractor and shall not be placed within any public street or alley.

    No container shall be used to hold materials weighting more than seventy pounds nor shall any container by used for the deposit of hot ashes.

    B.

    All items too large to fit into containers, such as, but not limited to, appliances, furniture and mattresses, shall be disposed of only at the city-county solid waste landfill site either by the resident or a licensed solid waste contractor.

    C.

    Only materials placed within the approved containers shall be picked up by the city-county or its licensed solid waste contractor.

    D.

    Containers shall be kept securely covered at all times.

    E.

    Any standardized container which has defects likely to hamper collection, cause spread of litter or injure the person collecting the contents thereof or the public generally shall be reported promptly by the owner or user of the container and shall be replaced by the city-county or its contractor. If the damage to the container is determined by the director of public works or the city-county's contractor, to have been caused by the negligence of the resident, the cost of replacement shall be charged to the resident.

    F.

    In placing containers for collections and removing them after collections, all residents shall follow these practices prescribed by the department of public works:

    1.

    Containers shall be placed at a location specified by the director of public works or his designee. Containers shall be placed upon a public street no more than twelve hours before time of collection and are to be removed no later than twelve hours after time of collection.

    2.

    To facilitate collection of standardized containers by automated equipment, containers shall be placed such that there is a minimum of three feet of clearance between the container and the nearest obstruction.

    3.

    To facilitate collection of standardized containers by automated equipment, a parked vehicle must provide a minimum of three feet of clearance to the nearest container.

    G.

    It is unlawful for any resident to deposit household solid waste in any receptacle maintained on a sidewalk or at any other location for disposal of litter by pedestrians.
