§ 6.08.030. Classes established—License fees.

    There shall be three classes of kennels as follows.

    1.

    A class one kennel shall be one in which animals are boarded and kept on any temporary basis including, but not limited to: (vacation care, convalescent care, day care, foster care) by the kennel owner for others whether for a fee or not. An operator of a class one kennel shall keep accurate records of all animals entering or leaving the facility, including, but not limited to, proof of current rabies vaccination. A class one kennel shall be situated on a parcel with a minimum of two acres and all facilities used for the kennel shall be a minimum of one hundred feet from any property line. The annual fee for a class one kennel shall be thirty-five dollars. If there are more than two full-time employees, the fee schedule shall comply with the general business license schedule set forth in chapter 5.04 of this Butte-Silver Bow Municipal Code. Veterinary hospitals are excluded from this definition and shall not be required to purchase a class one kennel license. The fine for operating an unlicensed class one kennel shall be one hundred dollars.

    2.

    A class two kennel shall be a breeding facility in which more than one litter of puppies is whelped annually. A class two kennel must be situated on a parcel with a minimum of two acres and all facilities used for the kennel shall be a minimum of one hundred feet from any property line. The annual fee for a class two kennel shall be fifty dollars. The fine for operating an unlicensed class two kennel shall be one hundred fifty dollars.

    A class three kennel shall be one in which an individual or family owns four or more adult dogs at any one time. A class three kennel must be on a parcel with a minimum of ten thousand square feet per adult dog. Housing and feeding areas must be set back fifteen feet from any property boundary. The fee for a class three kennel shall be forty dollars in addition to each animal license. The fine for operating an unlicensed class three kennel shall be one hundred dollars.

    B.

    Every person, firm or corporation licensed under this chapter shall be subject to regulation, inspection, control and supervision by the animal services program manager and a health department.
