§ 6.04.060. Noisy animal.

  • Every person who keeps, feeds, harbors or allows to stay about any premises occupied or controlled by such person, any animal which unreasonably annoys or disturbs by its continuous and habitual barking, howling, yelping, whining or other noise constitutes an annoyance or disturbance to the neighborhood or to any considerable number of persons shall be declared a public nuisance. This section does not apply to an animal that is owned, kept or harbored as part of the business of a licensed veterinarian, animal boarding facility or agricultural or livestock operation. The complainants must identify themselves by name, address and telephone number. To constitute a violation for prosecution under this section, a written complaint must be received by the animal services department which shall include, but not be limited to, a summary of the nature and duration of the animal noise and any other information as may be required by the animal services department to establish a violation of this section. Failure of the person to abate the public nuisance within seven days of receiving written notification from the animal services department may result in a complaint being filed against the person for any further annoyance or disturbance caused by such animal.
