§ 5.66.080. Liability—Enforcement—Penalty.

A.

It is unlawful for any person to violate any of the provisions of this chapter by doing any act forbidden or by failing to perform any duty imposed herein and any such act or omission shall be deemed a misdemeanor and jurisdiction for prosecution thereof shall be vested in the city court of the city and county of Butte-Silver Bow, Montana.

B.

The penalty imposed for violation of any of the provisions of this chapter shall be a fine not to exceed five hundred dollars or imprisonment in the Butte-Silver Bow City-County Detention Center for a term not to exceed six months, or both, and in addition a ten dollar surcharge shall be imposed and such ten dollar surcharge shall be deposited in the law enforcement patrol vehicle replacement fund.
