§ 2.53.040. Definitions.

The following definitions are provided for the sole purpose of proper interpretation and administration of this chapter:

A.

"Cemetery" means the Butte-Silver Bow cemetery located in Section 31, Township 4 North, Range 9 West, P.M.M., Butte-Silver Bow County, Montana, which was formerly referred to as the Sunset Silver Bow Cemetery.

B.

"City-county" means the local government of the city and county of Butte-Silver Bow, Montana, a municipal corporation and political subdivision of the state of Montana.

C.

"Department of public works" means the public works department of the city and county of Butte-Silver Bow, Montana and may also be referred to as the department.

D.

"Trust fund" means the perpetual care and maintenance fund already existing in the investment account. The perpetual care and maintenance fund shall remain in the investment account. Its use shall be interest only. The fund shall be invested according to city-county investment policies to maximize interest earnings on investments. Perpetual care and maintenance shall not include payment of salaries or wages for any employee. Extraordinary perpetual care and maintenance requests must be approved by the council.
