§ 2.18.030. Misdemeanor probation office.

  • There is established and created a Misdemeanor Probation office, which shall:

    A.

    Administer a program of supervision for individuals placed on probation by the District Court, the Justice of the Peace Court or the City Court for the City-County of Butte-Silver Bow, Montana, including establishing rules of probation and levels of supervision.

    B.

    Detain or authorize the detention of probationers upon reasonable cause to believe the probationer has violated the terms of his/her probation.

    C.

    Provide written reports of violation to the District Court, the Justice of the Peace Court or the City Court for the City-County of Butte-Silver Bow, Montana, and provide testimony at revocation hearings set by the city court and justice of the peace.

    D.

    Conduct field work including verification of probationers' residence and employment and compliance with other probationary conditions.

    E.

    Coordinate and work cooperatively with other city-county departments, other outside agencies and treatment providers in order to monitor the overall compliance of supervision conditions placed upon persons subject to misdemeanor probation.

    F.

    Facilitate the performance of community service by the probationers and work cooperatively with the entities scheduling the community service.

    G.

    Monitor the payment of restitution ordered by the District Court, the Justice of the Peace Court or the City Court for the City-County of Butte-Silver Bow, Montana.

    H.

    Allow for timely and efficient data sharing and coordination between all offices and departments of the city-county.

    I.

    Complete the minimal training at the Montana Law Enforcement Academy set forth in section 46-23-1002 MCA.

    J.

    Order the arrest of an offender and be authorized to carry a firearm, including a concealed weapon when necessary, subject to fulfilling and being in compliance with the firearm training requirements and procedures adopted by the department of corrections for probation and parole officers employed by the state.
