§ 10.52.070. Parking or leaving vehicles on public property restricted.

  • A.

    It is unlawful for any person to park or leave standing a vehicle upon the right-of-way of any public highway for a period longer than forty-eight hours, or upon a street of Butte-Silver Bow, or upon any property of the state of Montana or the city and county of Butte-Silver Bow for a period longer than five days.

    B.

    It is unlawful for any person to park or leave standing upon the right-of-way of any street, highway or alley, or other public property within the jurisdictional area of Butte-Silver Bow any vehicle, including attachments thereto, which has an overall length in excess of two hundred twenty-eight inches (nineteen feet) or an overall height in excess of ninety inches (seven and one-half feet) for a period longer than forty-eight hours in any consecutive seven-day period. A vehicle shall be presumed to be unlawfully parked or left standing if the vehicle has not been relocated more than three hundred feet within the specified time frame.

    C.

    It is unlawful for any person to park or leave standing upon the right-of-way of any street, highway or alley, or other public property within the jurisdictional area of Butte-Silver Bow any vehicle, including attachments thereto, which has an overall length in excess of two hundred twenty-eight inches (nineteen feet) or an overall height in excess of ninety inches (seven and one-half feet) within thirty-five feet of any of the following:

    1.

    A public or private driveway;

    2.

    An intersection; or

    3.

    A fire hydrant.

    D.

    It is unlawful to park any trailer, including but not limited to travel trailers, camp trailers, utility trailers, flatbed trailers, and boat trailers, whether occupied or not, on any street, highway or other public property within the city and county of Butte-Silver Bow or in any public place other than in an approved trailer court or storage area for more than "forty-eight" hours in any consecutive seven-day period.

    E.

    For the purposes of this section, a vehicle shall be presumed to be unlawfully parked or left standing if the vehicle has not been moved more than three hundred feet within the time period set forth in subsections A, B and D of this section.
